We are delighted to welcome you to Living Intentionally. It is our pleasure to provide the services stated below in line with these Terms of Service ("Terms").

The following terms and conditions apply to any coaching and mentoring services given by Jenna Sinclair ("the coach") to any individual or organization ("the client") and serve as the contract for the service to be delivered by Jenna Sinclair. The word 'coaching' as used here refers to a professionally led process that motivates clients to reach their full potential on both a personal and professional level. It is an organized, deliberate, and transformative process that assists clients in identifying and testing alternative strategies for improving competence, decision-making, and overall quality of life. Coach and client collaborate on strictly private conditions in a partnership agreement. Clients are experts on the content and decision-making level in this partnership; the coach is an expert at properly directing the process.

In the spirit of ethical behavior, when you purchase coaching services from me, I require you to affirm that you have read and agreed to each statement below and that you intend to proceed.

All coaching services and correspondence, whether via email or otherwise, provided by me, Jenna Sinclair, as well as material contained on this website (www.livingintentionally.co.uk), are intended to assist you in achieving Purpose, Alignment, and Authenticity. Coaching is not intended to take the place of professional mental health or medical treatment.

The term 'coaching' as used here encompasses not just life and personal coaching, but also executive and corporate coaching for clients.

Jenna is constantly seeking to improve the level of service she gives to her clients. The client will be requested to submit a feedback form at the conclusion of the coaching process, or set of coaching sessions.

 

Modification of These Terms

​

Living Intentionally retain the right, at its sole discretion, to modify, add, or delete any of the Terms, conditions, and notices that apply to the Site. It is your obligation to review these Terms on a regular basis for any modifications we may make. By continuing to use this Site after the effective date of any modifications to these Terms or other policies, you acknowledge and consent to those changes.

Prohibited Use

​

As a condition of using the Site, you promise that you will not use it for any purpose that is unlawful or prohibited by these Terms, conditions, and notices, including but not limited to the following:

  • You shall adhere to all relevant laws, including but not limited to those governing privacy, intellectual property, export control, and regulatory obligations.

  • You shall use the Site professionally, and you will not use the Site in any way that might damage, disable, overburden, or impair the Site, or affect the use and enjoyment of the Site by any other person.

  • You are not permitted to access or attempt to gain any materials or information by any means other than those made explicitly available or offered through the Site.

  • Without our prior express written authorization, you will not use any robot, spider, other automated device, or manual method to monitor or copy the Site or any of its contents or information.

  • You undertake not to use any device, program, or routine to disrupt or attempt to disrupt the normal functioning of the Site or any transaction done through the Site.

  • The information you provide to us shall be free of viruses, Trojan horses, worms, time bombs, cancelbots, or other computer programming routines that are designed to damage, adversely interfere with, or steal any system, data, or information, and shall not create liability for us or cause us to lose (in whole or in part) the services of our ISPs or other suppliers.

  • You undertake not to duplicate, reproduce, change, modify, create derivative works from, or publicly display any material (save for information in which you have an ownership interest) from the Site without our express prior written authorization or the express written agreement of the applicable third party.

  • You are not permitted to print, download, or otherwise utilize the underlying HTML, text, audio clips, video clips, and other content made accessible to you on this Site for any purpose other than to collect and save your personal information. 

  • Without restricting the preceding in any way, you may not:​

    • Any component of the site, use of the site, or access to the site may not be reproduced, duplicated, copied, sold, rented, resold, or exploited for commercial purposes in any way.

    • Without the express written consent of living intentionally, you may not create a hyperlink to any page or location on the site, or a frame containing any section of the site, on any other web site or text document that supports hyperlinks.

    • Copy such information to your own web site or magazine, or to any other web site or publication.

    • Appoint another individual to do any of the aforementioned acts.

  • Incorporate such content into or with the creation or distribution of any product or service.

 

If you obtain access to information or material that was not intended for your use, you undertake to promptly tell us, destroy any copies of such information in your possession, and refrain from disclosing such information to any third parties.

Use of Communication Services

​

The Site may include bulletin board services, chat sections, news groups, forums, communities, personal web pages, and calendars, as well as other messaging or communication facilities that enable you to engage with the general public or with a group (collectively, "Communication Services").

You agree to use the Communication Services for the sole purpose of posting, sending, and receiving messages and content that are appropriate and connected to the specific Communication Service.

To illustrate, but not restrict, you agree that when using a Communication Service, you will not:

  • Defame, abuse, harass, stalk, threaten, or otherwise violate the legal rights (such as privacy and publicity rights) of others.

  • Publish, post, upload, distribute, or disseminate any topic, name, content, or information that is improper, profane, defamatory, infringing, obscene, indecent, or illegal.

  • Upload files containing software or other protected intellectual property (or privacy or publicity) rights unless you own or control the rights thereto or have obtained all relevant consents.

  • Upload files that include viruses, corrupted files, or other similar software or programs that may impair the Site's or another user's computer's functionality.

  • Unless the Communication Service expressly permits such messages, you may not advertise or offer to sell or acquire any products or services for any business reason.

  • Conduct surveys, competitions, pyramid schemes, or chain letters and distribute them.

  • Download and/or distribute any file submitted by any user of the Communication Services that you are aware, or should reasonably be aware, cannot be disseminated legally in this manner.

  • Falsify or omit any author attributions, legal or other required notices, or proprietary designations or labels indicating the origin or source of software or other information included in an uploaded file.

  • Restriction or impediment to another user's use and enjoyment of the Communication Services.

  • Violate any relevant code of conduct or other standards for any particular Communication Service.

  • Without their agreement, harvest or otherwise acquire information about people, including email addresses.

  • Violate any applicable local, state, or federal laws or regulation.

 

Please keep in mind that Living Intentionally is not required to monitor the Communication Services. However, Living Intentionally retains the right, in its sole discretion, to evaluate any activity and materials associated with the Communication Services and to suspend or delete any activity or materials at any time, for any reason, and without prior notice to you. Additionally, Living Intentionally retains the right to suspend or terminate your access to any or all of the Communication Services at any time and for any reason.

Additionally, Living Intentionally retains the right to disclose any information required to comply with any applicable law, regulation, legal process, or governmental request, or to edit, refuse to post, or remove any information or materials, in whole or in part, in our sole discretion. Living Intentionally will not be liable to you for any loss you may incur as a result of our removal, editing, or disclosure to regulatory agencies or law enforcement, nor will Living Intentionally be liable for the activities or inactions of other users, including anything included in your or any third party's contributions. You undertake to hold Living Intentionally harmless from all costs, expenses, damages, or liabilities incurred as a result of your use of the Site or any of your contributions.

Always use caution when disclosing personally identifiable information about yourself or others over any Communication Service. Living Intentionally does not control or endorse the content, messages, or information contained in any Communication Service, and so disclaims any duty with regard to the Communication Services and any actions resulting from your participation in any Communication Service.

The use, reproduction, and/or dissemination of materials submitted to a Communication Service may be restricted by imposed limits on their usage, reproduction, and/or dissemination. If you download the contents, you are responsible for adhering to any restrictions.

Without the express written permission of Living Intentionally or the applicable trademark owner, any use of them is absolutely forbidden.

All third-party trademarks not owned by Living Intentionally that appear on this Site are the property of their respective owners. The display of any trademarks or trade names on this Site does not constitute or imply the grant or creation of any license or other right in or to these trademarks or trade names. Any unlawful use of third-party trademarks is expressly forbidden.

Coaching Disclaimer

​

By agreeing to work with me on a life coaching basis, you recognize the following:

​

  • You acknowledge that the coaching services provided by your Coach are not meant to replace professional mental health or medical treatment and are not designed to diagnose, treat, or cure any mental health or medical condition. Additionally, you recognize that your Coach is not a mental health counselor or a medical expert.

  • To the extent permitted by law, you acknowledge that coaching is currently an unregulated sector and that your Coach is not "licensed" by any UK authority, despite the fact that sessions may take place in England or other English-speaking countries.

  • You acknowledge and accept that you are solely responsible for your own well-being during and following your coaching sessions, including your choices and decisions.

  • You recognize that coaching is not a substitute for counseling, psychotherapy, psychoanalysis, mental health care, or drug abuse treatment, and you agree not to utilize it in place of any type of therapy.

  • You accept that your Coach's comments and suggestions are made purely to assist you in accomplishing the set goals you develop with your Coach. You have the power to offer informed permission and hereby do so to your coach in order to assist you in accomplishing such goals, while acknowledging that outcomes are not guaranteed.

  • You realize that to the degree that our work together involves personal growth, professional advancement, or company success, your Coach does not guarantee outcomes such as introspection, enhanced personal satisfaction, career advancement, profitability, or business success.

 

 Data Protection

You acknowledge that unless you specify otherwise in writing, your Coach will treat your information as confidential. If you report child abuse, elder abuse, or neglect, or if you threaten to hurt yourself or another, you acknowledge that required steps may be taken and that your confidentiality agreement may be limited in this capacity. Additionally, if a court orders your Coach to give information or testify, he will comply to the degree required by law.

Data Security

​

You understand that the use of technology is not always secure and you accept the risks of confidentiality in the use of Zoom.

​

Waiver

​

You hereby release, waive, and forever discharge your Coach, any agents, successors, assigns, personal representatives, executors, heirs, and employees from any claim, suit, action, demand, or right to compensation for damages you may claim to have or that you may have arising out of acts or omissions by yourself or your Coach in response to your Coach's advice or otherwise resulting from the coaching relationship contemplated by this agreement.

Additionally, you declare and indicate that no promise, incentive, or agreement to sign this agreement was offered to you in any way not expressly stated in this agreement. Your heirs, executors, personal representatives, successors, assigns, and agents are all bound by this agreement.

 Terms & Conditions

The coaching schedule will be determined in consultation with the client and may be reserved up to __3__ months in advance. Jenna will make recommendations on the number of coaching sessions after doing a thorough assessment of the client's needs, however the final number of sessions is decided at the discretion of the client. This advice, or plan, is not binding and may be revised and adjusted by mutual consent during the coaching journey, according to the provisions of this agreement.

Where no set number of sessions is agreed upon, sessions will be delivered on an individual basis.

Jenna undertakes to offer the service mentioned below and in line with the terms and conditions set out below in exchange for the money payable by the customer (or a third party on their behalf). The customer agrees to pay the service's fees in accordance with the terms and conditions outlined below (in situations where a third party pays the fees, the third party counts as an agent acting on behalf of the client).

The date of the first coaching session shall be assumed to be the service's commencement date. Any client who is dissatisfied with any of the terms and conditions may contact Jenna to discuss their issues and attempt to address them prior to the first coaching session. Acceptance of these terms and conditions is deemed to occur with an individual's participation in the first coaching session.

Format of Sessions

​

Coaching sessions are conducted online through Zoom or in-person outside in Sussex. By mutual agreement, the coach is open to different forms. Jenna is accountable for being available for coaching at agreed-upon hours.

The duration of each session is determined by the customer at the time of booking via the appointment booking platform and is paid for appropriately. Sessions may be extended by mutual consent and billed retroactively, but only if the Coach does not have any pressing responsibilities after the session.

Session Fees

​

Jenna's current rates are specified on the website and made explicit during the booking process. She maintains the right to make changes to these at any moment. Payments made in advance for sessions are honored regardless of whether rates have increased between the time of booking and the time of the session.

​

Dates and Times of Sessions

​

The date and hour of the first session, as well as any following sessions, will be recorded on the website's online calendar. Jenna undertakes to maintain her availability in accordance with the website's representations and to honor sessions booked using the online bookings platform.

​

Payment Terms

​

Payments can be made online with a debit or credit card or using PayPal. Unless otherwise agreed, fees are collected in advance of each coaching session. Jenna is not obligated to offer a coaching session if she has not been paid in advance. Where payment is due upon receipt of the invoice rather than in advance, a late payment fee may be assessed.

​

Between Sessions

​

Jenna may give activities or exercises to clients to accomplish in between coaching sessions. While the client is not required to complete these 'homework' assignments, failure to do so may impede the client's progress toward improved quality of life or desired business or personal goals.

​

Between sessions, the client may contact Jenna via phone or e-mail to obtain clarity on any matter emerging from the coaching session or for administrative concerns (e.g. where a client needs to rearrange a coaching session or make a payment). Additional coaching can be offered between sessions at an additional cost. Jenna will always inform a client in advance if the nature of the client's interaction is likely to result in an extra charge, and no further costs will be imposed without the customer's consent.


 

Session Readjustment

​

If a client wishes to reschedule a coaching appointment, they must do so at least 24 hours in advance. Clients will not be refunded for unused coaching sessions until 24 hours notice is provided. Jenna may need to reschedule a coaching session in rare circumstances. In certain circumstances, she will also provide the customer with a 24-hour notice, if possible.

If a client pays for a session or series of sessions in advance, they must complete the coaching session(s) within six months of the purchase or their fee will be lost.

​

Late Cancellations

​

If a client arrives later than the agreed starting time for a session, the session will not be extended beyond the original end time of the session and the time will be lost. If the client does not arrive, without notification to Jenna (either at info@livingintentionally.co.uk or on 07982904647) up to 15 minutes after the start time, the session will be marked as canceled and the session may be forfeited.

Confidentiality

​

Clients' personal and business information provided during coaching sessions will be maintained as confidential. It will not be released to a third party without the client's prior consent, unless as needed by law or to avoid harm to the client or another person.

​

Early Termination

​

Jenna reserves the right, in extraordinary situations, such as unacceptable client behavior, real or perceived conflict of interest, or other reasons, to terminate the client's service early or to reject or be unable to deliver more coaching sessions to the client. Jenna will offer fair notice of cancellation and will reimburse any advance money collected for coaching sessions not yet performed.

Responsibilities

​

Jenna will work with the client to help them enhance their quality of life or accomplish their goals. Clients who adhere to a defined strategy and are committed to it can accomplish remarkable outcomes. However, the client is solely responsible for making significant life or business decisions. Jenna is not liable for any loss incurred by a client, financial or otherwise, following the commencement of coaching sessions, or for the client's perceived failure, justified or not, to achieve a material improvement in trauma recovery, quality of life, career, or business, or to achieve their desired outcomes or goals.

Variation of Terms & Conditions

​

Where an Initial Number of Sessions has been agreed, any changes to these terms and conditions intended to take effect prior to the conclusion of those Initial Number of Sessions will take effect only if agreed to in writing by Jenna and the client and confirmed by Jenna through email or letter. In other instances, Jenna may amend any of these terms or conditions, including the Per Session Fee, by providing one week's written notice to the client through letter or e-mail (s). If the client decides not to proceed with further coaching sessions after receiving such notification of change, they may immediately withdraw from the service by notifying the provider in writing via email or letter. They will then be entitled to a full refund of any fees paid in advance for coaching sessions not yet provided. This notification will take effect upon Jenna's receipt of it.

Governing Law

​

This contract is governed by English law, and the courts of England have exclusive jurisdiction over any dispute, disagreement, lawsuit, or legal claim of any kind pertaining to the service supplied or the contract.
